The Supreme Court of Canada will announce next Thursday whether it will hear a high-profile case from British Columbia's Interior involving Universal Ostrich Farms in Edgewood.
The farm owners are contesting a cull mandated last December by the Canadian Food Inspection Agency (CFIA). The order followed an outbreak of avian flu that reportedly affected the ostrich flock, leading to the death of 69 birds.
The CFIA maintains that even apparently healthy ostriches can spread the virus, including new mutations. Contrarily, the farm owners argue the healthy survivors should not be culled.
The Supreme Court issued a temporary stay of the cull order and directed that the CFIA take custody of the birds until it decides on whether to hear the case.
The farm’s owners have faced several defeats in lower courts prior to this pending Supreme Court decision.
